Norman's identification of a ventral system embodying a constructivist theory of perception is rejected in favor of an ecological theory of perception and perceptual learning. We summarize research showing that a key motivation for the ventral-constructivist connection, percept-percept coupling, confuses perceptual and post-perceptual processes.

The purpose of this study was to adapt the Austrian-German version of the Multidimensional Inventory for Religious/Spiritual Well-Being into the Italian language and culture, and to investigate possible associations between the RSWB dimensions, “Big Five” personality factors and mental illness within an Italian student sample. Hence, the first Italian translation of the MI-RSWB scale was applied on a sample of 412 undergraduate students in three different cities and regions of Italy: Padova, Rome, and Palermo. Like the original Austrian-German scale, we (...) were able to find convincing psychometric properties for the new Italian version of the scale. By mirroring previous research, the RSWB-dimensions turned out to be substantially associated with personality dimensions, as well as negatively related with a global measure of mental illness. Our initial results confirm that these RSWB-dimensions are important facets of personality and mental health. (shrink)

Applied general equilibrium models have received considerable attention and scrutiny in the public debate over the North American Free Trade Agreement. This collection brings together the leading AGE models that have been constructed to analyse NAFTA. A variety of approaches to modelling trade liberalization are taken in these studies, including multi-country and multi-sectoral models, models that focus on institutional features of particular sectors affecting multinational firms and rules of origin, and models with some inter-temporal structure. Further, by constructing stylized models, (...) theoretical linkages have been identified that drive numerical results in the larger AGE models. The volume also assesses what can be learned about the likely economic effects of NAFTA from the collection of studies taken as a whole. Areas in need of further study have been highlighted. Medical-legal partnerships connect legal advocates to healthcare providers and settings. Maintaining effectiveness of medical-legal partnerships and consistently identifying opportunities for innovation and adaptation takes intentionality and effort. In this paper, we discuss ways in which our use of data and quality improvement methods have facilitated advocacy at both patient (client) and population levels as we collectively pursue better, more equitable outcomes.

Foucauldian discourse analysis (FDA) is a methodology that is well suited to inquiring into nursing knowledge and its organization. It is a critical analytic approach derived from Foucault's histories of science, madness, medicine, incarceration and sexuality, all of which serve to exteriorize or make visible the ‘positive unconscious of knowledge’ penetrating bodies and minds. Foucauldian discourse analysis (FDA) holds the potential to reveal who we are today as nurses and as a profession of nursing by facilitating our ability to identify (...) and trace the effects of the discourses that determine the conditions of possibility for nursing practice that are continuously shaping and (re)shaping the knowledge of nursing and the profession of nursing as we know it. In making visible the chain of knowledge that orders the spaces nurses occupy, no less than their subjectivities, FDA is a powerful methodology for inquiring into nursing knowledge based on its provocation of deep critical reflection on the normalizing power of discourse. Der forskes stadig i Aristoteles verden over, men moderne fortolkere drager kun sjældent nytte af den rige ældre tradition. Denne bog beskriver og sammenligner fortolkningsmetoder og publikationsstrategier hos skolastikerne og nutidens aristotelikere. Der argumenteres for, at dele af den gamle metodik (...) med fordel kunne genoptages, og det vises, at der i konkrete tilfælde kan findes værdifulde fortolkningsforslag, som ikke ses i den nyere litteratur. We survey the development of “California Phenomenology”, both as a philosophical movement originating with Dagfinn Føllesdal’s formulation of a Fregean, analytic reading of Husserl in the late 1950s and 1960s, and as an evolving network of philosophers working throughout California, who have met under the auspices of several groups in a more or less continuous way since that time. We trace the history of these groups in detail, provide an overview of debates that occurred between “West Coast” approaches to Husserlian (...) phenomenology and other approaches, and survey the broad panorama of more recent work. Within the debate concerning reason and rationality, instrumental incoherence was for a long time conceived of as the paradigm of irrationality. However, with the emergence of the so-called ‘bootstrapping objection’ and the debate concerning the ‘scope’ of rational requirements, the innocuous status of the normative significance of (instrumental) coherence became subject to. This led to a paradigmatic shift in how to understand the relationship between rational requirements and normativity. While there now exists considerable doubt that rational requirements are normative, it (...) is commonly agreed that one’s normative point of view is a key feature of one’s rationality. Here the question is not only if one can hold a particular normative judgement and still be rational; what is significant too is whether your normative outlook coheres appropriately with your motivation. In fact, it is now commonly agreed that rationality requires us to intend to make the world fit with our first-personal ought beliefs. Enkrasia (i.e. coherence between your normative views and your motivation) is thus seen as a rational ideal and as a source of rational requirements. Nevertheless, many elementary questions regarding the application, content, and significance of an enkrasia-requirement remain unanswered, or subject to debate. This special issue on ‘The Nature of the Enkratic Requirement of Rationality’ aims to answer some of these fundamental questions. (shrink)

It argues that there are two possible definitions of state- and process-requirements: a satisfaction- based definition and a content-based definition. I demonstrate that the satisfaction-based definition is inappropriate. It does not allow us to uphold a clear-cut distinction between state- and process-requirements. We should therefore use a content-based definition of state- and pro- cess-requirements. However, a (...) content-based definition entails that ra- tionality does not issue process-requirements. Content-based process- requirements violate the principle that ‘rationality requires’ implies ‘can satisfy’. Es wird versucht nachzuweisen wiesehr Husserl neben der immer erneuten Übung der Phänomenologie als ein Instrument genauester philosophischer Analyse immer mit metaphysischen Fragen „alten Stils” beschäftigt gewesen ist : Ursprung der Welt, Existenz Gottes, Möglichkeit und Sinn der Geschichte, Unsterblichkeit. Solche und ähnliche Probleme hat er angeschnitten und neu zu beantworten versucht auf dem von ihm nie verlassenen Boden der transzendentalsubjektiven Phänomenologie. Die Frage ist eben wie eine solche Phänomenologie, die vom Bewusstsein als dem Absoluten, das „nulla ‘re’ indiget ad (...) existendum” ausgeht und daran immer festgehalten hat mit der metaphysischen Problematik ins Reine kommt, namentlich wenn das mit der Transzendenz Gottes gemeinte Absolute dem Bewusstseinsabsoluten gegenüber als „ total verschieden” und „übertranszendentalsubjektiv” bezeichnet wird. Stösst das transzendentale Bewusstsein irgendwo auf Absolutes, das es unter Verzicht auf seinen konstitutiven Leistungscharakter ohne weiteres hinzunehmen hat ? Von Fink stammt die Bemerkung dass man Husserl als dem „Philosophen des Kleingeldes” seine unspekulative Gesinnung nicht als Schwachheit anrechnen darf, weil in der sorgfältigen Analyse eben seine Stärke liege. Ich möchte demgegenüber betonen dass eine „manque d'esprit métaphysique” sich bei Husserl eben nicht nachweisen lässt, wie auch aus seinen geschichtsphilosophischen Bemühungen eindeutig hervorgeht. In dieser letzten Beziehung liesse sich fragen inwiefern eine Philosophie, die den Ursprung der Geschichte in die transzendentale Subjektivität verlegt auf die „wirkliche” Geschichte als das „grosse Faktum des absoluten Seins” sich zu berufen ein Recht hat. Jedenfalls dürfte klar sein dass es neben Husserl, dem geduldigen, sorgfältigen, auf das Detail hinsehenden phänomenologischen Analytiker einen durch metaphysische Fragen in andauernder Unruhe versetzten Husserl gegeben hat. Congress's national-security legislation will often require clear and specific congressional authorization before the executive can undertake certain actions. The War Powers Resolution, for example, prohibits any law from authorizing military hostilities unless it "specifically authorizes" them. And the Foreign Intelligence Surveillance Act of 1978 required laws to amend FISA or repeal its "exclusive means" provision before they could authorize warrantless electronic surveillance. But efforts to legislate clear-statement regimes in national-security law have failed to induce compliance. The Clinton Administration inferred (...) congressional "authorization" for the 1999 Kosovo War from an appropriations statute that failed to specifically authorize the conflict. And the Bush Administration inferred congressional "authorization" for the NSA surveillance program from ambiguous language in the post-September 11th Authorization to Use Military Force. In both situations, executive-branch lawyers employed expansive theories of implied repeal and constitutional avoidance to evade the codified clear-statement requirements, and Congress and the courts acquiesced to the President's actions. Recent proposals to strengthen the clear-statement requirements in Congress's national-security framework legislation are unlikely to be effective without institutional mechanisms, such as points of order, that can deter future legislators from enacting vague or ambiguous legislation from which the executive might claim implicit congressional "authorization," and that can induce Congress to confront Presidents that act without specific congressional authorization. Simply enacting more narrow or explicit clear-statement requirements, or adding funding restrictions to Congress's framework legislation, fails to counter the aggressive interpretive doctrines that executives of both political parties have used to concoct congressional "authorization" from vague or ambiguous statutory language. In the opening chapter of the Iudicium de Dinarcho Dionysius quotes a passage from the Περì μωνμων of Demetrius Magnes, mat the end of which come the words δ λξις ςτ το Δεινρχου κυρως θικ πθος κινοσα σχεδòν τ πικρí μóνον καì τ τóν το Δημοσθθενικο χαρακτρος λειπομνη το δ πιθανο καì κυρíιυ μηδν νδονσα. [I have deliberately omitted all punctuation marks, because the punctuation of this sentence is still doubtful, though I hope to suggest a possible interpretation of its (...) meaning at the end of this article.] Now there is nothing in this sentence or in the words preceding it to indicate beyond all possibility of doubt the precise meaning ofκυρíως θικ. And in such circumstances, to allow free play to personal prejudices regarding the significance of thephrase is more than dangerous. The whole problem of θικ λξις has been treated too cursorily. If one mentions the phrase to a non-professional student of Greek, who, however, has some acquaintance with the Attic orators, he immediately replies: ‘I suppose you mean the sort of thing you meet in Lysias.’ And he is to beexcused, because, after all, that is the predominant meaning of the term. But it has other senses, and therefore one must fight shy of vague statements like that of Finke, who, after quoting the above lines, comment: ‘Demetrius Magnus attribuit ei τν κυρíαν λξιν qua non sit Demosthene inferior’; or of Burgess, who enumerates qualities, ideas, and topics ‘of special value to the epideictic and court orators, ’ among which appears θοποια which he merely translates ‘impersonation or delineation of character, ’ without offering any further comment. Sandys talks of ‘the ethical warmth of colouring, by which the dullest details are lit up with a fresh life and interest.’ Gromska is even more vague (and seems almost to confuse θς and χαρακτρ: ‘Grammatici antiqui, qui de Hyperide tractabant, de eloquentiae eius genere disputabant, orationum Hyperidearum compositionem et θς respicientes, i.e. quantum in arte rhetorica et oratoria valeret, examinantes.’ In the hope, therefore, of being able to represent the difficulty inherent in these lines, and of attempting to remove it, or at any rate to shed a broader beam of light upon it than has been shed hitherto, I propose to review very briefly the fluctuations of meaning in the life of this phrase and its equivalents, as we find them used in the critical writings of the Greek philosophers and rhetoricians. A growing amount of media is paid for by its consumers through their very consumption of it. Typically, this new media is web-based and paid for by advertising. It includes the services offered by Facebook, Instagram, Snapchat, and YouTube. We offer an ethical assessment of the attention economy, the market where attention is exchanged for new media. We argue that the assessment has ethical implications for how the attention economy should be regulated. To conduct the assessment, we employ two heuristics (...) for evaluating markets. One is the “harm” criterion, which relates to whether the market tends to engender extremely harmful outcomes for individuals or society as a whole. The other is the “agency” criterion, which relates not to the outcomes of the market, but rather, to whether it somehow reflects or has its source in weakened agency. We argue that the attention economy animates concerns with respect to both criteria and that new media should be subject to the same sort of regulation as other harmful, addictive products. (shrink)

Such formulations are vulnerable to conditional fallacy problems; counterexamples threaten whenever the C-conditions’ coming to obtain might alter the object with respect to F. Crispin Wright has suggested that such problems can be avoided by placing the C-conditions in a proviso. This ensures that any changes (...) triggered by the C-conditions’ coming to obtain will be irrelevant to the truth of the biconditional. I argue that this move leaves the equations vulnerable to counterexamples of a slightly different kind : Cases where the change is triggered, not by the C-conditions’ coming to obtain, but by the response. I consider two ways to resist these counterexamples, and argue that both are insufficient. The upshot is a challenge that must be met if provisoed biconditionals are to serve their purpose. (shrink)

We offer an ethical assessment of the market for data used to generate what are sometimes called “consumer scores” (i.e., numerical expressions that are used to describe or predict people’s dispositions and behavior), and we argue that the assessment has ethical implications on how the market for consumer scoring data should be regulated. To conduct the assessment, we employ two heuristics for evaluating markets. One is the “harm” criterion, which relates to whether the market produces serious harms, either for participants (...) in the market, for third parties, or for society as a whole. The other is the “agency” criterion, which relates to whether participants understand the nature and significance of the exchanges they are making, if they can be guaranteed fair representation, or if there is differential need for the market’s good. We argue that consumer scoring data should be subject to the same sort of regulation as the older FICO credit scores. Although the movement in the 1990s that was aimed at regulating the FICO scores was not aimed at restraining a market per se, we argue that the reforms were underwritten by concerns about the same sorts of problems as those outlined by our heuristics. Therefore, consumer data should be subject to the same sort of regulation. (shrink)

Holm (2022) argues that a class of algorithmic fairness measures, that he refers to as the ‘performance parity criteria’, can be understood as applications of John Broome’s Fairness Principle. We argue that the performance parity criteria cannot be read this way. This is because in the relevant context, the Fairness Principle requires the equalization of actual individuals’ individual-level chances of obtaining some good (such as an accurate prediction from a predictive system), but the performance parity criteria do not guarantee any (...) such thing: the measures merely ensure that certain population-level ratios hold. Impermissivists hold that an agent with a given body of evidence has at most one rationally permitted attitude that she should adopt towards any particular proposition. Permissivists deny this, often motivating permissivism by describing scenarios that pump our intuitions that the agent could reasonably take one of several attitudes toward some proposition. We criticize the following impermissivist response: while it seems like any of that range of attitudes is permissible, what is actually required is the single broad attitude that encompasses (...) all of these single attitudes. While this might seem like an easy way to win over permissivists, we argue that this impermissivist response leads to an indefensible epistemology; permissive intuitions are not so easily co-opted. In managers' dynamic, real-world environments, they often feel it is necessary to exercise some creative discretion over employee ratings. Most managers do not describe their ratings of subordinates in performance appraisals as completely honest or accurate. The inaccuracy is often in the form of inflated ratings. They justify the inaccuracy by sighting, among other things, the need to avoid confrontation with subordinates, damaging working relationships, and creating permanent written documents which may later harm a subordinate's career. Many of these motives (...) are not only well intentioned, but are designed to enhance individual, unit, and organizational performance (some of the ultimate objectives of performance appraisal systems.) This paper examines the ethics of this sort of deliberate manipulation of performance appraisal systems. It suggests that at the organizational level, performance appraisal is usually seen as an end in itself, and a formalist ethical critique is applied. At the managerial level, performance appraisal is usually seen as a means to an end, and a utilitarian critique is applied. Since both perspectives are essential, we conclude that a Janus-Headed analysis is needed. We suggest some duties and obligations for both the organization and the manager engaged in performance appraisal. (shrink)

Eugen Fink is considered one of the clearest interpreters of phenomenology and was the preferred conversational partner of Edmund Husserl and Martin Heidegger. In Play as Symbol of the World, Fink offers an original phenomenology of play as he attempts to understand the world through the experience of play. He affirms the philosophical significance of play, why it is more than idle amusement, and reflects on the movement from "child's play" to "cosmic play." Well-known for its non-technical, literary (...) style, this skillful translation by Ian Alexander Moore and Christopher Turner invites engagement with Fink's philosophy of play and related writings on sports, festivals, and ancient cult practices. New media (highly interactive digital technology for creating, sharing, and consuming information) affords users a great deal of control over their informational diets. As a result, many users of new media unwittingly encapsulate themselves in epistemic bubbles (epistemic structures, such as highly personalized news feeds, that leave relevant sources of information out (Nguyen forthcoming)). Epistemically paternalistic alterations to new media technologies could be made to pop at least some epistemic bubbles. We examine one such alteration that Facebook has made in (...) an effort to fight fake news and conclude that it is morally permissible. We further argue that many epistemically paternalistic policies can (and should) be a perennial part of the internet information environment. (shrink)

This paper examines the practice of using predictive systems to lengthen the prison sentences of convicted persons when the systems forecast a higher likelihood of re-offense or re-arrest. There has been much critical discussion of technologies used for sentencing, including questions of bias and opacity. However, there hasn’t been a discussion of whether this use of predictive systems makes sense in the first place. We argue that it does not by showing that there is no plausible theory of punishment that (...) supports it. (shrink)

I argue for a new delimitation of what Kant means by ‘cognition [Erkenntnis]’, on the basis of the intermediate, transitional place that Kant gives to cognition in the ‘progression [Stufenleiter]’ of our representations and our consciousness of them. I show how cognition differs from mental acts lying earlier on this progression—such as sensing, intuiting, and perceiving—and also how cognition differs from acts lying later on this progression—such as explaining, having insight, and comprehending. I also argue that cognition should not be (...) confused with ‘knowledge [Wissen]’, insofar as knowledge represents the culmination of a separate orthogonal progression of acts of ‘holding-true’. Along the way, I show how having in focus the specific progression from representation, to consciousness, to cognition allows us to better appreciate the architectonic significance of the progression of Kant’s analysis in the first Critique, and also helps to illuminate the unity of Kant’s account of cognition itself across its variety of forms. There has been considerable recent debate about whether Kant's account of intuitions implies that their content is conceptual. This debate, however, has failed to make significant progress because of the absence of discussion, let alone consensus, as to the meaning of ‘content’ in this context. Here I try to move things forward by focusing on the kind of content associated with Frege's notion of ‘sense ’, understood as a mode of presentation of some object or property. I argue, first, that (...) Kant takes intuitions to have a content in this sense, and, secondly, that Kant clearly takes the content of intuitions, so understood, to be distinct in kind from that possessed by concepts. Along the way, I show how having in focus the specific progression from representation, to consciousness, to cognition (and beyond) allows us to better appreciate the architectonic significance of the progression of Kant’s analysis in the first Critique (and beyond), and also helps to illuminate the unity of Kant’s account of cognition itself across its variety of (empirical, mathematical, philosophical) forms. Art-science, as its name suggests, combines art with science. The idea of combining art and science raises the question whether the outcome, art-scientific works, can succeed against a standard properly belonging to them. In other words: can there be such a thing as an art-scientific work, or do such works merely belong to either art or science while superficially seeming to belong to the other sphere as well? Surprisingly perhaps, these concerns overlap with a chief point of contention as regards (...) Adorno’s mature thinking, in particular his Aesthetic Theory ([1970] 2002): whether or not it is coherent to believe that knowledge can have an aesthetic form. This essay is motivated by the thought that Adorno’s reflections are useful for understanding contemporary art as well, and the burgeoning paradigm of art-science represents a welcome occasion to ask the reverse question: can art become theoretical? The first aim of this essay is, accordingly, to consider how Adorno’s negative dialectic of philosophy and art might illuminate the field of art-science, how its works might express sui generis truths. In turn, an examination of how the aestheticisation theme in Adorno might be appropriated for the business of art-science critique, might tell us something about the relationship between artistic content and philosophical interpretation, beauty and truth, in Adorno.
